Terms of Use

These Terms of Use (“Terms”) govern your use of the Underneath mobile application (“the App”), operated by Thanos Rokkas (“we,” “our,” or “us”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service
Underneath is a food label scanning application that allows users to scan product barcodes, view ingredient analysis, health scores, and additive information. The App offers both free and premium features through a paid subscription (“Underneath Plus”).
2. Eligibility
You must be at least 13 years of age to create an account and use the App. By using the App, you represent that you meet this age requirement.
3. Account Registration
To access certain features, you must create an account using Apple Sign-In, Google Sign-In, or email. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to notify us promptly if you suspect unauthorized use of your account.
4. Subscriptions and Payments
4.1 Underneath Plus
The App offers an auto-renewable subscription called Underneath Plus, available as:
- Weekly subscription
- Annual subscription
4.2 Billing
Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. Prices are displayed in the App and may vary by region.
4.3 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
4.4 Managing and Cancelling Subscriptions
You can manage or cancel your subscription at any time through your device’s subscription settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
4.5 Free Trial
If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App’s servers or infrastructure
- Use automated systems (bots, scrapers) to access the App
- Circumvent any access controls or subscription requirements
- Misrepresent your identity or impersonate another person
6. Health and Nutritional Disclaimer
The health scores, ingredient analysis, additive alerts, and nutritional information provided by Underneath are for informational purposes only. They do not constitute medical advice, dietary guidance, or a substitute for professional health consultation.
We make reasonable efforts to ensure accuracy, but product data is sourced from third-party databases and may contain errors or be outdated. Always read the physical product label and consult a qualified healthcare provider before making dietary or medical decisions.
Underneath is not responsible for any health outcomes resulting from reliance on information provided by the App.
7. Intellectual Property
All content, design, branding, and code within the App are owned by us and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
Product data displayed in the App (names, ingredients, images) is sourced from Open Food Facts under the Open Database License (ODbL).
8. Account Deletion
You can delete your account at any time from within the App by navigating to your profile and selecting “Delete account.” Account deletion is permanent and will remove your profile, scan history, subscription records, and all associated data. 9. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine to be harmful to the App, its users, or us.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for all claims arising from or related to the App shall not exceed the amount you have paid for your subscription in the 12 months preceding the claim.
11. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
12. Privacy
Your use of the App is also governed by our Privacy Policy, available at underneath.app/privacy.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. If we make material changes, we will notify you through the App.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Greece, without regard to conflict of law principles.
